On Death Row....
The newspapers and editorials are full of news about the hanging of Mohd Afzal , one of the main accused in the 2001 parliament attack case.
When we read about such an article, the first emotion that our mind grapples with is sympathy. We reason that since we cannot give life, we have no right to take it away either. To some extent, this is correct. We should not indiscriminately hang people who are suspected of less than lethal crimes. The supreme court has stated that the death penalty should be given in the 'rarest of rare' cases. The last time a person was hanged in India, was in 2004. Dhananjay Chatterjee was hanged for raping a 14 year old girl and his mercy petition was rejected by our president.
Agreed, the death penalty has been abolished by many nations, and even those who allow it, very rarely practice it. But isn't Afzal's case one of the 'rarest of rare' cases? Do we need a more stronger reason to sentence a person to death? The parliament is symbolic of our sovereignty. It is the place where one of the most important decisions are taken which impact the lives of a billion Indians. Agreed, 90% of our politicians are corrupt bastards, but that doesn't undermine the importance of the Parliament in our democracy. The attack on it was clearly designed to damage the very fabric of democracy, by people who have never experienced it in their respective countries.
Afzal's involvement with the gunmen who entered the Parliament has clearly been proved. The Supreme court has already upheld his death sentence, characterizing him as a "menace to the society", whose "life should become extinct" to satisfy "the collective conscience of the society".
But inspite of all this, the newspapers and T.V. channels are full of pleas for mercy for him. The chief minister of J&K, Ghulam Nabi Azad has personally requested Dr. Kalam to consider Afzal's mercy petition. Isn't it shameful that the topmost official in a state is recommending mercy for a terrorist? The media as usual, is at its whorish best. Talk shows are being conducted, interviews are taken, the journalists are burning the midnight oil. In the quest for high T.R.P's, they are sensationalizing and exploiting this issue to the max. After October 20'th no matter if he will be hanged or not, Afzal will disappear from the screens and newspaper columns. No one would care anymore, and the media sharks will run in search of another victim, and another.......
Coming back to the core issue, I think the president should grant mercy to those sentenced to death only in the case of crimes done in the heat of the moment. For eg:- self defense. This provision should not be misused for each and everytime a person is sentenced to death. Can Ghulam Nabi Azad give a guarantee that Afzal, if acquitted, will not indulge in terrorist activities again?
And don't we as a nation, owe a debt to CRPF Jawan Kamlesh Kumari and seven others who laid down their lives in the encounter with the terrorists? Kamlesh Kumari was the first to intercept the terrorists' car. She was felled by 11 bullets in her stomach. She was awarded the Ashok Chakra, the highest peacetime gallantry award. The least we all can do is ensure justice for her family. They have said that they will return the Ashok Chakra if Afzal is freed.
I would like to end with a quote from Thomas fuller which is quite apt to this situation: "Law cannot persuade, where it cannot punish"

hey ganesh.. thoroughly enjoyed reading this post.. i cant believe that people bk home are even thinking of a mercy petition fr this guy.. i mean wht more does he have to do to prove his worthiness for the death penalty??? and the media behavior is truly disgusting.. always abt pushing their cart forward.. wonder.. whtever happened to the ethic that we dont stop short of screaming off rooftops..

interesting post and I know how every one wants the death penalty for this man.but how can we pick and choose who is to be put to death.I am against the death penalty, I think so many innocent people are put to death because of flaws in the judicial system..I think he should be severly punished for the crimes committed, but taking someones life places you in the same catogory as the killer himself.
Im totally against death penalty. By killing the criminal we r only doing what he did. Who's going to punish us then?

The person who didnt even think of the mercy thing during the attacking the parliament, y shud we show mercy to him.....he shud be hanged...(theres a very lill chance tht hes not gonna repeat the same thng in future...)
I think these sort of ppl must be tortured fr the rest of the their lives cos death is too easy fr such heartlessppl. But again our indian politics has so many loop holes that such ppl will escape v,easily! Shame!
Not death penalty. I guess 3rd degree torture for the rest of his life wll be good. Will keep on reminding him for the rest of his life of the offence he commited. These kind of creatures are not afraid of death. Thats something too easy to come. Torture will also make the future-similar-minds-at-work, to think twice.!!

Exactly, the clemency petition should be used for genuine cases, not for terrorists like him.

There are very few criminals who go to the gallows nowadays, If treachery against the nation is not a category to recieve the death punishment, then what else is?

If we do not kill him, he will continue his terror activities which will lead to probably 100's of more deaths, now, will that be acceptable?

I also thought about the torture thing, but should we waste our taxpayers money which could be used to better purposes?
Plus what if other terrorists hijack a plane demanding their release. Considering this, I support capital punishment.
At times I feel that encounter should happen more frequently for these kind of people. they sit in jail, waste time of lawyers and judges all in the tax money we pay. kill them and it is only one bullet's cost that the nation has to bear (one of the best dialogues I love to quote from "Kaaka Kaaka")

I see so much hatred and anger here. We r never gonna know what true compassion is until we let go of that hatred/revenge in ourselves. And we will never be able to set an example to others if we keep doing the same sin on criminals. Then we r no better than them r we?
Ganesh I'm not asking to set him free. There r ways to rehabilitate a person with a smaller IQ and zilch compassion. And that doesn't mean going down to the same levels as they r. Today's society operates on revenge...thats why all these wars and killings go on for years w.o. any respect for human life. So should we be turning over a new leaf, or should we continue with the eye-for-an-eye strategy?

There is anger, yes...but not hatred...
Every now and then, there is a suicide bomb attack by some jihadi zealot and hundreds of innocent people are killed.
It's the same case everytime, the police makes hundreds of arrests but the real culprits always go unpunished. Even if they are sentenced, some organization will try to hijack a plane to get them freed. India had to free 3 dangerous terrorists to get hundreds of passengers freed on a hijacked plane IC-814.
That's why I supported the death sentence. These people are brainwashed, indoctrinated and filled with hate. There is no way we can reform them.
my demand is death penalty and as brutal as that could be. have u forgotten the treatment given to our young soldiers in kargil?
if islam says that everyone should be treated as per the shariat laws, let mr ghulam nabi azad find a proper ritual for him.
and treat these media ppl and bleeding heart intellectuals with the same stick.
i think they should go to pakistan and practice their brand of compassionate feelings from there.

Islam allows the death penalty...Infact no religion except Jainism and Buddhism condemns capital punishment...
We can't afford to pardon terrorists or to even keep them in jail for the rest of their lives...taxpayers money is more valuable than that....
I quote M Karunanidhi " Dont hang him, it will be over in a few minutes. give him life sentence instead". I beleive that.
Over history, executions were only creating negative impacts.

Nope, sorry, not in my mind.. I think we should go a step further by giving those people the death the same way they did to others. Why just kill them in a minute when they cause so much pain to others & their families..? they should suffer more..
